GENERAL TERMS AND CONDITIONS FOR DISTANCE SALES


In order to better meet the expectations of its customers, in addition to its online shop Srokes Watch has created a system for conducting distance sales of a selection of Srokes Watch Items (hereinafter "Items") by phone and by Internet.

Article 1 - Scope and acceptance of the General Terms of Sale.

These General Terms of Sale apply to all distance sales of Items:

1) by telephone through the customer support department set up by Srokes Watch and described in Article 2.1 of these General Terms of Sale (hereinafter “Customer Service”) and

2) through the Srokes Watch website identified by the domain name "www.srokes.com" (hereinafter "the "Site").

The items are sold to end users who are natural persons acting for strictly personal purposes unrelated to any commercial activity, excluding all distributors and all intermediaries acting on behalf of distributors (hereinafter "Customer (s)" or "You").

Therefore, you confirm that you are acting as a consumer and do not intend to resell the Items for commercial purposes.

You also confirm that you have the legal capacity to express your agreement to these General Terms of Sale.

Each time you purchase Articles or an Article on the Site, you must indicate that you agree to the General Terms of Sale of Srokes Watch and the applicable Privacy Policy (hereinafter “Privacy Policy”) by clicking on “Validate payment and confirm my order ”. You can view these documents before and at any time after confirming your purchase.

Srokes Watch may update and change these General Terms of Sale and will notify Customers of such changes by email. The terms that apply to the sales of the Items are those that are in effect at the time the sales contract is formed.

Customers are invited to read the Privacy Policy for additional information on how Srokes processes the personal data it collects on the Site and / or by telephone.

Article 1 - Order information

You can place orders on the Site.


On the Site, orders can be placed in: German, English, French, Dutch, Portuguese, Italian, Spanish.

The language of the sales contract depends on the country where the Site from which you purchase the Items is hosted.


2.2 Orders placed through the Site

2.2.1 Selection of Items by Customers

Special orders, such as orders for custom items, unique pieces, etc. (without personalization) cannot be placed through the Site.
On the Site, Customers select, enter and validate the designation and quantity of the Items they wish to order,and the items are added to their "Cart". The quantities shall be limited in accordance with Article 4 below.

Online customers are free to change the content of their Carts, delete Items or change the quantities ordered, or add Items by clicking the appropriate buttons.

2.2.2 Identification

Once you have completed the selection of Items and are ready to validate the contents of your Cart, you can either:
• log in to your Client account (hereinafter “Account”) or

You can also log in before selecting any Item.

If you already have an Account, you need to sign in with your email address and password.
If you don't have an Account yet, you can create one by entering your name, street address, email address, and phone number when you place your order.
Your account will become active once it is confirmed by Srokes Watch via a confirmation email.

You cannot change your address once you have placed an order. You must place another order with the new address.

Your login details and password are strictly personal. Therefore, you agree to keep them safe and not disclose them to a third party.

You also agree to immediately notify Srokes Watch in the event of loss or theft of your login details and / or password or any fraudulent use of your Account.

Srokes Watch cannot be held liable for any direct or indirect damages caused by fraudulent access to your Account or the Site, or for your inability to access your Account or the Site.

2.2.3 Validation of orders

You must choose the delivery method and provide all the information needed to ship the order:
- email address,
- name and surname,
- street address,
- Postal code
- Town
- no. by phone
- billing address,
- payment method and payment information.

You can use the delivery address as your billing address, or enter another.

Once you have entered and validated all this information, the price of the Items (as defined in Article 5 below), as well as any shipping charges and estimated delivery date will be displayed automatically.

You need to check that your selection is correct before confirming your order.

To help its Customers detect any errors, Srokes Watch provides technical verification means in the form of a standard summary of completeness and plausibility checks (which verifies that all required fields have been completed and that the characters that have been entered are appropriate for the field in question).

Your order details are then summarized again for final verification.

You can place a firm order for the Item or Items in the Cart only if you read, then agree to these General Terms of Sale and Privacy Policy by clicking "Validate Payment and Confirm My Order".

2.2.4 Confirmation of the order by Srokes.com

After completing the steps described in Article 2.2.3 above, you will be emailed an order confirmation. . Unless expressly stated otherwise, confirmation of receipt of the order does not constitute acceptance of your order.

The contract of sale is considered to have been formed when Srokes confirmed the acceptance of your order by e-mail.

Acknowledgment of receipt of your order includes the order number, the total value of the order, information about the delivery cost and delivery date, as well as the key characteristics, quantity and price of the Item (s) purchased.

When the Ordered Item (s) have been shipped to the delivery address you provided, Srokes.com will send you an email informing you of the delivery and that it has received payment of the price in accordance with the provisions of Article 5 below. .

2.3 Proof of order

In general, you and Srokes Watch expressly agree that the emails and automated registration systems used by Customer Service are legally valid and binding, in particular as to the nature and date of your order. .

In addition, Srokes Watch keeps all information about your orders in accordance with legal provisions and makes this information available to you at your request sent to support@srokes.com.

However, for orders placed through the Site, we recommend that you keep a copy (electronic or paper) of your order information.

Article 3 - Availability of Articles

Srokes.com reserves the right to modify the Article (s) offered on the Site at any time and without prior notice. Such changes will not affect orders that have already been placed.

Before placing an order, the information page of the Site that describes each Item will tell you:

- whether the Article is available or not; or
- if the Item is temporarily unavailable, if you can order it for future delivery within the specified time frame.

If, despite Srokes Watch's efforts, you order Items that are no longer available, Srokes Watch will inform you as soon as possible using any means (telephone or e-mail).

As an exception, if an Ordered Item is no longer in stock, Srokes Watch must cancel the order and you will not pay anything.

Article 4 - Non-acceptance of the order

Srokes Watch may refuse any fraudulent or abnormal order, in particular any order that exceeds the authorized number of Items, namely:

- eight (8) Custom items; and / or

- two (2) Identical items ordered within thirty (30) calendar days, regardless of color or size.


Srokes Watch may also refuse any order (i) placed by a Customer with which there is a dispute over payment or delivery of a previous order or (ii) which does not comply with these General Terms of Sale.

If Srokes Watch finds that your order does not comply with these General Terms of Sale, it will notify you directly on the Site, by telephone or by e-mail.

If you do not correct the order information that is incorrect or contrary to these General Terms of Sale within fourteen (14) calendar days of receiving such notice, Srokes Watch may cancel the order and make the corresponding payment.

Article 5 - Prices of Articles - Invoicing

The prices are indicated by the Customer Service or displayed on the Site in euros (€) and include all taxes,  include shipping fees.

The invoiced prices are the prices in force on the date of the order, provided that the ordered item (s) is available at that time.

Srokes Watch reserves the right to change the price of the Item (s) at any time and without notice, but such changes will not apply to orders you have already placed.


You will receive a written confirmation of the price paid for each Item and your shipping costs at the latest upon delivery.

Article 6 - Terms of payment

You will be informed of the estimated delivery date in accordance with Article 7 below.

6.1 Payment by Credit Card or Debit Card

You can pay for your purchases with your credit or debit card. 'CB', Visa ©, Eurocard ©, MasterCard ©, American Express © and Apple Pay © cards are accepted.


When you order on the Site, you will access a secure server that operates in SSL mode (128 bits) after validation of bank details.

In this way, your transaction is carried out in accordance with bank security standards. Authentication is specific to each bank. Providing credit card number or debit and / or bank details to Srokes Watch on the Site, you agree in advance and unconditionally that Srokes Watch may continue the secure transaction and pre-authorize the bank to debit your account upon receipt of records or statements sent by Srokes Watch , even in the absence of receipts signed by the cardholder.

6.2 Payment via PayPal (only for Internet orders)

Srokes Watch accepts payment via Paypal.

When you validate your order, choose the Paypal payment option; you will be automatically redirected to the Paypal platform.

Then you need to sign in to your PayPal account using your login and password. If you do not have a PayPal account, you can create one on this occasion. After validating your order with PayPal, you will be redirected to the confirmation page of the Site.

The order will only be shipped after verification of the payment method, receipt of your card debit authorization or confirmation from Paypal and compliance of your order with these General Terms of Sale and after the availability of the Item (s) has been verified.

Article 7 - Delivery

The items can be delivered worlwide. If you want to order an Item and deliver it worlide, it is possible.

Srokes Watch will process any order for which the delivery or billing address is a mailbox and will only deliver to a hotel or student residence if you opt for express delivery with proof of personal delivery.


After registration of the order payment, the Items will be delivered to the delivery address you indicate when you order. Therefore, you must make every effort to provide the correct delivery address to Srokes Watch
Subject to full payment of the price, the ordered items will be delivered:

- on the date or within the time period indicated to you by Srokes Watch before the confirmation of your order or, in the event that no time limit has been indicated, no later than thirty (30) days from the date of the order;
- or
- if the item is temporarily unavailable, within the time period you were informed of and accepted when you added the item to the Cart on the Site, as well as before accepting your order.

Depending on the option you select, Srokes Watch will ship the items ordered by standard mail or express courier with proof of personal delivery or will deliver them

If the delivery of the Items is delayed by an event that cannot be controlled by Srokes Watch, you will be contacted as soon as possible and steps will be taken to mitigate the effects of the delay. Provided that Srokes Watch makes every effort to reduce the delay, the company will not be liable for the delay caused by the event. However, if there is a risk of a significant delay, you can contact Srokes Watch to cancel the contract and get a refund for any item you paid for but did not receive.

If UPS cannot deliver the order (after 3 unsuccessful attempts) and the package is returned to the Srokes Watch warehouse with the indication “Not available at this address”, Srokes Watch will try to contact you twice in the four (4) weeks following receipt of the package at the warehouse. If you do not respond or contact us within these four (4) weeks, Srokes Watch will refund your order and send you a confirmation email to the address you provided when placing your order.



Article 8- Intellectual Property Rights

You may not reproduce, represent or adapt the Site, directly or indirectly, in whole or in part, in any form. Any intellectual property rights that belong to Srokes Watch product or item , such as intellectual property rights in trademarks, illustrations, photographs, images, designs and logos, whether or not registered, are and will be remains the exclusive property of Srokes Watch

Any total or partial reproduction, downloading, modification or use of Srokes Watch trademarks, illustrations, images, photographs, logos or designs for any reason and on any medium is strictly prohibited without the prior written consent of Srokes Watch.

Similarly, any use that does not comply with the license to use the Site and, in particular, the use of any of the components of the Site (Articles presented, descriptions, prices, data, software, graphics, images, texts, photos, tools, etc. .) for sale or any other direct or indirect commercial use is strictly prohibited without the express prior written consent of Srokes Watch


Article 9 - Right of withdrawal

9.1 Right of withdrawal

As a consumer, you have the right to withdraw from the contract within fourteen (14) days without justifying your decision.

The withdrawal period ends fourteen (14) days from the date on which you or the third party you have designated (other than the carrier) owns or has acquired physical possession of the Articles. If you have ordered items to be delivered separately by a single order, the withdrawal period ends fourteen (14) days from the date on which you or the third party you have designated (other than the carrier) owns. or you have acquired physical possession of the last item.


In order to meet the withdrawal deadline, you simply need to send the withdrawal notification before the deadline.

The right of withdrawal does not apply to purchases of goods that have been made to order or that are clearly personalized, or to goods that you have unsealed and that cannot be returned for health or hygiene reasons.

9.2 Effects of withdrawal

If you exercise your right of withdrawal, we will refund all payments we have received from you, including shipping charges (except for additional charges incurred in your choice of a delivery method other than free standard shipping). -a reasonable time and, in any case, no later than fourteen (14) days from the date on which we were informed of your decision to withdraw.

We will make the refund using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. Indiferent by the way the refund is made, you will not incur any cost for it.

You are only responsible for any decrease in the value of the Item caused by any manipulation other than necessary to determine its nature, characteristics and method of operation.

Article 9.3- Voluntary return policy

However, you will not be able to return:

- Personalized items, adapted or made to order;
- Items that were permanently attached to other items after delivery;
- Items that have been sealed for health or hygiene reasons (eg swimsuits) and that you have opened after receiving them.


Items that are not returned or are returned incomplete, damaged, unlabeled, altered, dirty or in any other condition that would reasonably suggest that they have been used or worn, will not be refunded or exchanged and will be returned to you (if any). applicable).


Returned items must be in their original condition and not in use, with all Srokes Watch  Item labels attached and all related accessories or instruction booklets included.

If you return an Item more than thirty (30) days from the date you receive, Srokes Watch may refuse to grant a refund and may return the Item to you.

In addition, recipients of gifts do not have the right to withdraw. Only Customers can exercise this right.

Your right of withdrawal in accordance with Article 12 is not affected by the right to make a voluntary return. Until the expiry of the withdrawal period laid down in Article 9, only the provisions of that Article shall apply.

10 Policy on voluntary returns through the Site

You can return Items within thirty (30) days of purchase by:

1. notifying Srokes Watch through your account on the Site that you wish to return an Item or Items, in which case Srokes Watch will send you an email confirming receipt of the cancellation;

The invoiced price for the Item (s) returned through the Site will be refunded by the means of payment you used to pay for the order, within a reasonable time and no later than fourteen (14) days from the receipt by Srokes Watch of the Article (s).

Any additional costs you have paid due to the choice of a specific delivery method will not be refunded.

Article 11 - Exchanges

In addition to your right to withdraw and return the Articles as set out in Articles 9 and 10 of this Agreement, you have the right to change your mind and change an Article within thirty (30) days, in accordance with the terms set out in Articles 9 and 10.


Within thirty (30) days of receiving an Item, you may change it through the Site or directly in a Srokes Watch store in the country in which you purchased it.

Items that have been customized or made to order, items that have been altered or damaged, and sealed items (such as swimwear) that you have opened upon delivery and that cannot be returned for health or hygiene reasons cannot be changed.

Without touching of your rights under Article 10, Srokes Watch may, in accordance with its exchange policy, refuse to exchange more than two (2) successive orders.

You cannot make two shifts in connection with the same order.

Exchanges are subject to the availability of the Articles on the Site . If an Item is not available, you will receive a refund in accordance with Article 9.

14.1 Exchanges through the Site

If you change your mind and wish to exchange an Item through the Site, you must indicate in the relevant section of the Site which Item (s) you wish to receive in exchange for your order. You may return the Items in accordance with Article 11 above ( term and terms of exchange).

The number of Replacement Items must be the same as the number of Items returned.

Shipping costs for the first delivery will be refunded, but the second shipment will be billed depending on the delivery method selected. The new sale will be subject to the General Terms of Sale in force upon exchange.



Article 12 - Your rights in case of defective Articles

If an Article is defective, legal provisions, including legal guarantees, apply.

Some Items sold on the Site are covered by a warranty in addition to the legal provisions.

Article 13 - After-sales service

In some cases, Srokes Watch offers its customers extensive commercial guarantees or guarantees that exceed the aspects to which its customers are legally entitled. In such cases, the details of the commercial guarantee will be included at the time of delivery of your Item (s).

All technically repairable items are eligible for after-sales service.


Article 14 - Information on Articles - Limitation of Liability -


The photographs, graphics and descriptions of the items offered for sale at a distance are for information purposes only and are not mandatory for Srokes Watch. You can get additional information by contacting Customer Service. Although every effort is made to ensure that the Articles presented on the Site correctly reflect the color and pattern of the Original Articles, variations may occur, in particular due to the technical limitations of your computer's ability to reproduce colors. Therefore, Srokes Watch cannot be held responsible for substantial errors or inaccuracies in the photographs or graphic representations of the Articles that appear on the Site.

If Srokes Watch does not comply with these provisions, it will only be liable for those losses or damages of yours which are the foreseeable result of Srokes Watch's breach of contract or the consequences of lack of due care and reasonable qualification. Srokes Watch will not be liable in any case for unforeseen losses or damages. Losses or damages are foreseeable if they obviously occur or if, at the time of the conclusion of the contract, you and Srokes Watch know that they may occur and, for example, you have discussed them with Srokes Watch during ordering process.

Article 15 - Miscellaneous

The fact that, at any time, Srokes Watch refrains from requesting the fulfillment of any of the provisions of these General Terms of Sale cannot be interpreted as a waiver of its right to subsequently state the complete or partial non-execution.

If any provision of these General Terms of Sale is declared void in whole or in part, the other provisions of these General Terms of Sale and the other rights and obligations arising therefrom will remain unchanged and will continue to apply.

Article 19 - Disputes - Applicable law

These General Terms of Sale are governed by Romanian law
